1. Your Personal Data Privacy

1.1 LIVVY is an integrated membership rewards programme managed and operated by iLogic Connects Corporation Limited (“We” or “Us”). We respect your legal rights of privacy when collecting, storing, using, and transferring personal data and this Privacy Policy Statement (the “Statement”) explains our privacy practices. It is our policy to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the “Ordinance”) of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). We collect personal data only for lawful and LIVVY related purposes, and we shall take reasonably practicable steps to protect your personal data and prevent unauthorized or accidental access, deletion, or other use. However, given the open nature of the internet, we cannot guarantee that risks can be completely eliminated.

1.2 Please read the following carefully to understand our policy and practices regarding how your personal data will be handled. This Statement applies to personal data collected through the LIVVY mobile application. LIVVY mobile application aims to facilitate and promote dining reservations, shopping experiences, and creative activities at the Motto by Hilton Hong Kong Soho. We have the right to modify and update this Statement as may be necessary from time to time, so please review it regularly. If you have registered for LIVVY membership and/or used our services, and each time you login to the LIVVY mobile application, you are deemed to have agreed to the privacy policy and personal information collection statement applicable at that time.

1.3 If there is any inconsistency between the English version and the Chinese version of this Statement, the English version shall prevail.

2. Collection of Data and Use

2.1 We shall collect your personal data as reasonably necessary, including but not limited to your name, residence, contact information, gender and birthday month so as to provide you with events, promotions, products and/or services. You are not obliged to supply us with the data, but if you do not, we may not be able to provide you with our events, promotions, products and/or services.

2.2 We shall use your personal data primarily for membership registration and the LIVVY related purposes, including but not limited to
- processing your application as a Registered Customer;
- providing you with our services;
- the normal management, operation, and maintenance of Our App;
- providing you with regular communications from us with details of our retail business and relevant benefits;
- providing you with Retail Goods or Services which you have requested;
- processing your order for purchases at Our Stores, including verifying your payment details/status;
- carrying out events, games or competitions which you have entered;
- carrying out data sorting and analysis to enable us to better understand your characteristics and buying behavior and to provide other services better tailored to your needs, and to assist us in selecting Retail Goods or Services that are likely to be of interest to you;
- designing new or improving existing services provided by us, Our Affiliates and/or Our Subsidiaries to you;
- investigation of complaints, suspected suspicious transactions, and research for service improvement;
- prevention or detection of crime;
- disclosure as required by law; and
- aggregated behavioural analysis.

2.3 If you are under the age of 18, you must seek the consent of your parent or guardian before registering for membership or providing us with any personal data.

3. Disclosure and Transfer of Personal Data

3.1 We shall take reasonably practicable steps to ensure the security of your personal data. For the purposes of LIVVY operation and related arrangements, we may disclose or transfer your personal data to third parties. Please refer to the “Personal Information Collection Statement” for details.

4. Use or Provision of Personal Data for Direct Marketing

4.1 We intend to use and transfer your personal data for direct marketing. Direct marketing is regulated by the Ordinance and we are required to obtain the necessary consent from you and comply with other regulatory requirements before we can use and transfer your personal data for direct marketing. Please refer to the “Use and Provision of Personal Data for Direct Marketing” section under the “Personal Data Collection Statement” about the scope and arrangements relating to direct marketing.

4.2 You may decide whether or not to accept direct marketing and have the right to change your choice at any time. If you would like to change your choice, please notify us in writing (please refer to section 10 below for details). We will process any request to refuse direct marketing without charge.

4.3 We may send you promotional information about products and services from time to time according to your choice of direct marketing. If you do not or no longer want to receive promotional information at any time, please send an email to info@livvy.com.hk or notify us in writing (please refer to section 10 below for details).

5. Links to Other Websites

5.1 LIVVY may provide hyperlinks connecting to the applications or websites of third parties, including but not limited to third parties used by us for providing contents, services and products. This Statement only applies to the LIVVY mobile application. If you click on any hyperlink linking to third party application(s) or website(s), you will leave the LIVVY mobile application and enter the third party application or website. We are not responsible for the collection and protection of personal data by the third party applications or websites. You are advised to read the privacy policy statement and personal information collection statement in the third parties’ application or websites to understand the arrangements.

6. Web Logs

6.1 When you visit the LIVVY mobile application, We will only collect data relating to your visits to or use of mobile application, including but not limited to your IP address, domain name, browser type and access time (“Web Logs”) but will not collect your personal data.

7. Cookies

7.1 We use cookies across our mobile application and website in order to improve their performance and enhance users’ online experience. Session cookies are used to enable users to browse and use the basic functions on our LIVVY mobile application, such as maintaining login details for the session so that the need to transfer information across the internet may be reduced. We may use cookies and other tracking mechanisms to track information about your use LIVVY mobile application (“Tracking Data”). We shall not collect any personal data from users when the cookies are being used.

8. Security

8.1 We shall take reasonably practicable measures to ensure the security of personal data. Your personal data, irrespective of how it is stored, will only be accessed or processed by our employees, agents, contractors and/or third-party service providers who are authorised to do so and who are under a duty of confidentiality to us and must follow our instructions.

9. Your Right of Access to and Correction of Your Personal Data

9.1 In accordance with the provisions of the Ordinance, you have the right to request access to and to correct personal data relating to you in our records at any time. If you need to exercise your rights, you may contact us at the address stated in section 10 below and please mark your communication “Confidential”. While processing your request, we may request you to provide information to verify your identity. We shall respond to your data access or correction request within the time period specified in the Ordinance. In accordance with the Ordinance, we have the right to charge you a reasonable fee for the processing of any Personal Data request.

11. Retention of Data

11.1 We shall take reasonably practicable steps to ensure that we do not retain your personal data longer than is necessary for fulfilling the purposes (including directly related purposes) for which the data was collected, except where the continued retention of personal data is required or permitted by the Ordinance.
11.2 In the event you cease to be a member of LIVVY for any reason, we shall retain your personal data for a reasonable period following the termination of your membership, except where the continued retention of personal data is required by the Ordinance.
